動画はYouTubeのモノ?：YouTube Owns Our Contents?-No.

Boing Boing quoted Eliot Van Buskirk at Listening Post as saying that YouTube recently changed its Terms & Conditions so that it can use every video uploaded to it. ;

Among other things, this means they could strip the audio portion of any track and sell it on a CD. Or, they could sell your video to an ad firm looking to get 'edgy'; suddenly your indie reggae tune could be the soundtrack to a new ad for SUVs. The sky's still the limit, when it comes to the rights you surrender to YouTube when you upload your video. - Listening Post

It its comments, however, you can see what the Terms of Service say in the chapter 5.;

"For clarity, you retain all of your ownership rights in your User Submissions. [...] The foregoing license granted by you terminates once you remove or delete a User Submission from the YouTube Website."

Valleywag also quoted the missing parts above, saying 'blogs like Boing Boing have it all wrong, criticizing this move.'

The latest comment to Boing Boing by YouTube Marketing Manager finally clarified what it really means.

To clarify, YouTube never intended to sell, and never obtained any rights to sell, any User Submissions on CD or other physical media. The sentence you quoted was intended to enable YouTube to syndicate all or part of our website through third party websites (including to enable our embed functionality), in mobile contexts, and similar types of syndication.

Boing Boingの記事「YouTube's new policy says "we own your content」はワイヤードの音楽系ブログのコレが元ネタ。利用規約が最近改訂になって、これからは動画の使用権がYouTubeに行っちゃうようだから皆さん気をつけましょう、という警告記事だ。

「これはつまり動画の楽曲トラックをCDに焼き付けて売ったり、”最先端”のものを求めている広告代理店に動画を売ったり、自分がインディーで作ったレゲエがSUVの新しい宣伝にいきなり使われちゃったりするってことだよ」（Listening Post）

YouTube公開用には画質落として出すとか予防策を張ろう、というんだが、早速コメント欄には；

利用規約第5条には”投稿作品の所有権は全て利用者に帰属する。[...]当社の権利はYouTubeから投稿を取下げ・削除した時点で終了する”って書いてるよ。

という指摘が...。Valleywagも上記を引用し、「Boing Boingなんかのブログが書いてるような批判はお門違いだ」としている。

いま念のためBoingBoingに戻ってみたら、YouTubeのマーケティング部長が上記の引用抜け部分をコメントで補足し、「YouTubeには投稿作品をCDその他の媒体に焼き付けて販売するような権利はありません。皆さんが引用された規約は外部ウェブとYouTubeがシンディケートできるよう（埋め込み含め）定めたものです」と明言している。まったく人騒がせな!

関係ないけどもListening Postにあったコレ、これまでYouTube買収の噂が出た企業がズラズラ出てきて面白い。むー、こんなにあったのね...
